Terms & Conditions

1. We are trying to set forth our “Terms and Conditions” in short form and in plain English. 

Certain definitions will be helpful:
“We,” “us,” “our,” and “1CC” - refer to 1ST CLASS CARE, LLC
Site – means the website: 1stclasscare.net
T & C – means the Terms and Conditions set forth in these pages.
Materials - means the information and documents shown on the site.
IMI – means the Introductory Medical Information Form in our “New Clients” page.

2. By your very entry to the site or use of any materials you agree to be bound by the T & C and any rules or guidelines showing in any of the pages of the site and if you break any of the T & C rules or guidelines you must stop using the site and destroy any materials you have downloaded.
3. By submitting your IMI, filled out as you did, you have released from liability and hold harmless 1CC and all of its affiliates like employees, officers, practitioners, etc. with respect to any 1CC services, any medical action suggested, and prescriptions issued or the use of medication prescribed and the results or lack thereof or reaction thereto.  You assure us that you are 18 years old or older, and that your IMI is truthful.
4. You chose on your own to use our service – at your risk and expense.  You know you must have regular physical exams by a medical practitioner (once a year) and you must keep any present or future doctor you use fully informed of your use of 1CC services.  You must give us your accurate medical records and keep us up to date on it.
5. We can’t guarantee results and give you no warranties.
6. You give us permission to let those allowed by HIPAA have access to your medical information.
7. 1CC services may be furnished to you by sources resident in and licensed (as necessary) in a state different from yours.
8. When you check the “I AGREE” button at the bottom of the "IMI" form in the New Clients page, that is the same as your signature.
9. We may change anything on the site at any time without notice and we apologize for but have no responsibility for errors in the materials.
10. The materials and trademark and identification in the site belong to 1CC and they are protected by laws such as trademark copyright and intellectual property and you can only use them to use 1CC services and you have a license to use them only to get 1CC services and certainly for no commercial purposes or distribution, and if we tell you to stop using any of these items, you must do so.
11. You give us the right to contact any health care provider mentioned in the medical records you submitted to us in order to confirm/secure information needed by us to serve your request.
12. You give us the right to receive prescriptions about you from a physician, to keep a copy of them and to forward the scripts either to you or a pharmacy

Privacy Policy

These pages set forth are 1st Class Care’s (1CC’s) policies and means for protecting the privacy of the personal information. In these pages “we” or “us” or “our” refers to 1CC.

1. 1CC does not sell, rent, or trade Personal Information. We keep it secure and confidential.
2. HIPPA - is our “Ten Commandments” and we will follow and be bound by it.
3. 1CC keeps your registration to avoid having to re-enter it for each transaction.
4. Personal information goes to those outside of 1CC only as necessary to provide you with our agreed services and then only if they agree to use the PI only for that purpose.
5. With the exceptions set forth herein, we will only share your personal information with others if:
• We have your consent; as set forth in the "I agree" box at the bottom of our New Client page.
• We consider that we are required to do so by law;
• We find that you are in breach of our terms and conditions or any of our policies or usage guidelines for specific products or services;
• It is necessary in our opinion to do so to prevent, investigate, detect or prosecute criminal offenses or attacks on the technical integrity of our site(s) or our network;
• It is necessary in our opinion to do so to protect the rights, property, or safety of 1CC and its employees, the users of our sites, or the public;
• As may be necessary for your diagnosis and treatment;
• To obtain payment for 1CC services or resulting medication;
• To support health care operations and to secure necessary licensing or approvals, to inform other health care organizations on your case, or to acquire services (i.e., ambulance);
• As necessary for public health and safety activities (birth, death, disease data, FDA required information, product recall data, domestic abuse services; or
• Medicare/Medicaid/Worker’s
Compensation.
6. We protect personal information by having it encrypted as we get it and we store on a secure server; plus we have in place a variety of other security measures.
7. To help us understand and work with our market, we may extract statistical date from our server data base but never is that date or the statistics individually identified.
8. If in 1CC site is linked to another site, 1CC is not responsible for their privacy policy and practice.
9. 1CC may change the Privacy Policy and these changes will be noted on these pages.
10. You should be aware that various state and federal laws protect certain highly confidential information about, for example, psychotherapy, mental health, drug and alcohol problems and treatment; HIV/AIDS data and genetic testing.
11. You can inspect and have a copy of you personal information and may request other documents (which we are not required to agree to).
12. You can revoke any authorization in writing and amend your medical or billing personal information.
